Terms of Service
These Terms of Service (“Terms”) govern your access to and use of the Rezdek property and HOA management platform (the “Service”), operated by ANB DIGITAL LLC (“Rezdek,” “we,” “us,” or “our”). By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service.
1. The Service
Rezdek provides web-based software to help property managers and homeowner associations manage residents, units, payments, maintenance, communications, and related tasks. We may add, change, or remove features over time. We may also impose reasonable usage and storage limits to protect the Service and ensure fair use across customers, and will give notice before applying limits that materially affect your use.
2. Accounts
You are responsible for the accuracy of the information you provide and for keeping your login credentials confidential. You are responsible for all activity that occurs under your account. Notify us promptly at help@rezdek.com if you suspect unauthorized access.
3. Subscriptions and Payment
Paid plans are billed on a recurring basis through our third-party payment processor. By subscribing, you authorize us to charge the applicable fees to your payment method until you cancel. Fees are non-refundable except where required by law. We may change pricing with reasonable notice; changes apply to the next billing cycle.
4. Acceptable Use
You agree not to:
- Use the Service for any unlawful purpose or in violation of these Terms;
- Upload content that infringes others’ rights or is unlawful, harmful, or fraudulent;
- Attempt to gain unauthorized access to the Service or other users’ data;
- Interfere with or disrupt the integrity or performance of the Service;
- Reverse engineer or copy the Service except as permitted by law.
5. Your Data
You retain ownership of the data you submit to the Service (“Customer Data”). You grant us a limited license to host, process, and use Customer Data solely to provide and improve the Service. Our handling of personal data is described in our Privacy Policy.
6. Intellectual Property
The Service, including its software, design, and branding, is owned by ANB DIGITAL LLC and protected by intellectual property laws. These Terms do not grant you any rights in the Service except the limited right to use it as permitted here.
7. Disclaimers
The Service is provided “AS IS” and “AS AVAILABLE,” without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or secure. Rezdek is a software tool and does not provide legal, financial, or tax advice.
8. Limitation of Liability
To the maximum extent permitted by law, ANB DIGITAL LLC will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, data, or goodwill, arising out of or related to your use of the Service. Our total liability for any claim relating to the Service will not exceed the amount you paid us in the twelve (12) months before the event giving rise to the claim.
9. Termination
You may stop using the Service and cancel your subscription at any time. We may suspend or terminate your access if you violate these Terms or if necessary to protect the Service or other users. Upon termination, your right to use the Service ends; sections that by their nature should survive (such as Disclaimers and Limitation of Liability) will survive.
10. Governing Law
These Terms are governed by the laws of the State of Texas, United States, without regard to its conflict-of-laws rules. Any disputes will be subject to the exclusive jurisdiction of the state and federal courts located in Texas.
11. Changes to These Terms
We may update these Terms from time to time. We will post the updated version here with a revised effective date. Material changes will be communicated through the Service or by email. Continued use after changes take effect constitutes acceptance.
